IMPORTANT NOTICE: THIS AGREEMENT CONTAINS A BINDING ARBITRATION PROVISION
AND CLASS ACTION WAIVER. IT AFFECTS YOUR LEGAL RIGHTS. PLEASE READ CAREFULLY.
Welcome to ASISH, a not-for-profit trust working towards eliminating
cancer and other life-threatening diseases through prevention, education, advocacy,
financial support, and nationwide awareness programs.
These Terms of Use ("Terms") govern your access to and use of all services,
websites, tools, products, and campaigns operated by ASISH ("Services").
By accessing or using our Services, you agree to be bound by these Terms.
Campaign: A cause or event for which ASISH seeks donations.
Donor: Any individual or organization contributing to a Campaign.
Members: Donors and all users of the Services.
You must be at least 18 years old (or 13 with parental consent) and legally capable of
entering into this agreement. If previously prohibited by ASISH, you may not use the Services.
ASISH may update these Terms periodically. Continued use of the Services
after updates constitutes acceptance of the revised Terms.
You agree to provide accurate and current information. You are responsible
for maintaining confidentiality of your account details. Notify us at
contact@ashis.org in case of unauthorized access.
All content including text, logos, graphics, software, and media
belongs to ASISH and is protected under Indian intellectual property laws.
Unauthorized use is strictly prohibited.
You may not:
- Copy, modify, distribute, or reverse engineer content.
- Use bots, scrapers, or automated tools.
- Send spam or unauthorized commercial content.
- Impersonate another person or entity.
- Interfere with other users' access to the Services.
Donors are solely responsible for evaluating Campaigns before contributing.
Services are provided "AS IS" without warranties of any kind.
ASISH is not liable for damages, losses, or interruptions.
Total liability shall not exceed the amount donated by you.
All disputes shall be resolved through binding arbitration under Indian law.
You waive your right to participate in any class action.
You may opt out within 30 days by emailing
contact@ashis.org with the subject line
“ARBITRATION AND CLASS ACTION WAIVER OPT-OUT”.
These Terms are governed by the laws of India.
Courts located in Kolkata, West Bengal shall have exclusive jurisdiction.
